I propose the following data to be a new case:

Description Users can’t fully opt out of tracking technologies used for non essential purposes such as advertising, marketing or analytics. This case doesn’t apply to functional cookies that are necessary to provide the services.

The case would apply to points similar to Point 15320 (ToS;DR Phoenix).
This is a blocker since the user may be asked for consent for installing some tracking technologies on the device, and even if all are rejected the service will still track its visitors and ignore the choice.

I agree with the proposal. In fact, I’m surprised that a case like this doesn’t already exist.
